Self-employment under temporary protection: KvK registration is not a work permit

1. Do not confuse KvK registration with work authorisation

Registration in the Chamber of Commerce Handelsregister confirms a business registration, but does not itself grant immigration authorisation to perform work. IND and Rijksoverheid state that self-employed work requires a TWV unless the person holds a separate residence permit allowing self-employment.

• check the labour-market endorsement on the IND document
• do not start an assignment merely because a KvK number exists
• identify the client and who must apply for the TWV in advance

2. Who obtains the TWV

Rijksoverheid states that the client must obtain the TWV for self-employed work. This differs from employment, where the TWV exemption applies and the employer notifies UWV.

• resolve authorisation before starting the contract
• check the permitted work and period
• retain the agreement, permit, invoices and correspondence

3. A self-employed residence permit is a separate route

IND has a separate residence-permit procedure for self-employed entrepreneurs. It has its own conditions, evidence and assessment; it does not arise automatically from temporary protection or KvK registration. Check eligibility and the consequences for the current status before applying.

4. Check for false self-employment risk

The contract label is not decisive. If the client in practice determines hours, place and method and supervises performance like an employer, the true nature of the relationship may be questioned.

Safer order: IND document → correct work form → TWV or another valid basis → only then start the assignment.
