What the IND announced

According to the IND, for new applications from 5 August 2026 a person subject to military-service obligations in Ukraine must in principle show that those obligations were fulfilled or that the person is exempt. This is the IND’s published position, not an automatic conclusion for every individual case.

Exceptions identified by the IND

The IND states that the condition does not apply to people who already had temporary protection in the European Union before 5 August 2026 or to people joining a family member who already has temporary protection.

  • Collect proof of earlier temporary protection in an EU Member State
  • Prepare BRP records, an IND sticker or card, correspondence and proof of dates
  • For a family route, include evidence of the relationship and the family member’s status

What to do after a refusal

Check the reasons, date of receipt and the legal-remedy section. The general objection period is often six weeks, but the instructions in the specific decision are decisive.

If the decision creates an immediate risk to residence, work or municipal reception, separately assess whether interim relief is needed while the main procedure is pending.
