1. Start with the remedy notice

The end of the decision should state whether to file an objection or go directly to court, where to submit it and the deadline. Do not copy a deadline from another case. Record when the letter arrived, keep the envelope and complete decision, and follow the route stated in your own document.

  • the complete decision and attachments
  • date and method of delivery
  • case reference and V-number without sharing them in group chats
  • the deadline and recipient written down separately

2. Separately check whether you may await the outcome in the Netherlands

The current IND page distinguishes situations. For an appeal against ending temporary protection or against a return decision issued before 4 March 2024, the IND describes continued directive rights until the judgment. For a return decision issued on or after 4 March 2024, the IND states that the outcome may be awaited in the Netherlands only if the court grants interim relief. Your own IND letter still needs individual review.

3. Interim relief is a separate urgent procedure

Rechtspraak explains that interim relief requires a pending objection or appeal and an urgent interest. The request should explain the urgency and temporary measure sought and include the challenged decision and supporting documents. Filing a request does not guarantee that it will be granted.

4. Do not confuse temporary protection with the asylum assessment

The IND states that it has resumed deciding asylum applications by Ukrainians who are not covered by the Temporary Protection Directive. While a person is covered, the IND does not decide that asylum application. Check the status of your application, reception and procedure against your own IND letters.

For an initial assessment, collect the decision, proof of receipt, residence document, return or reception letters, documents already filed and a short timeline. Share them only through a secure channel.
